Terms and Conditions
1. Acceptance of Terms
Welcome to “RAN Battle Royale Malaysia 2007”! You are invited to participate in the “RAN Battle Royale Malaysia 2007” (the "Tournament"), subject to the following terms and conditions. By indicating acceptance to these terms and conditions, you shall be subjected to any posted guidelines or rules applicable to the Tournament. All such guidelines or rules are hereby incorporated by reference into the terms and conditions of Gonzo Rosso (M) Sdn Bhd. Gonzo Rosso (M) Sdn Bhd reserves the right to update or revise the terms and conditions, from time to time. Notice of amendment may be given by Gonzo Rosso (M) Sdn Bhd to the participant in such manner as Gonzo Rosso (M) Sdn Bhd deems appropriate and continued access to “Ran Battle Royale Malaysia 2007” and participation signifies acceptance of the changes to the terms and conditions.
2. Program Description
The Malaysia National Tournament is scheduled on 8th September 2007(Penang), and 22th September 2007(Selangor) ("Tournament Period"). Whereby the Tournament registration start on 22nd August 2007. The Official Organizer of the event is Gonzo Rosso (M) Sdn Bhd.
3. Eligibility
This Tournament is open to all myRosso ~ RAN members who are citizens of Malaysia, except employees and immediate families members of Gonzo Rosso (M) Sdn Bhd and their advertising partners and sponsors. For participants below the age of 18 years, please seek permission from your parent and/ or guardians. By registering in this tournament, it shall be considered that such permission has been given.
4. How to join
For Online Registration
Log on to “RAN Battle Royale Malaysia 2007” (http://ran.myrosso.com/br/index.asp) official site. Click on “Registration” button and complete the registration form. Incomplete or illegible form will be disqualified from the event.
Successful and shortlisted participants will be announced on RAN Online website http://ran.myrosso.com/ and "RAN Battle Royale Malaysia 2007” (http://ran.myrosso.com/br/index.asp) official site. Shortlisted participants will also receive a confirmation email. Participants will be able log-in to the server using their account name and password created during registration to join the tournament.
All short-listed participants are required to play RAN Online (English Version) at the Official Cyber Café (Idol Cyber Cafe, Butterworth Penang & BlitZone, PJ Selangor) during the tournament period as appointed.
Finalists are required to attend Global Battle Royale 2007 that would be held in Bangkok, Thailand on 7th October 2007. Finalists will be notified on the date and time of the final tournament
5. Entries
Participants can start registering from 22nd August, 2007. Participants are allowed to register once per event based on their Personal Identification Number and their login id used on myRosso portal. A single customer using 2 different login IDs is considered 1 participant and only the first successful submission entry is accepted. Subsequent entries will be disqualified. Each qualified entry on every stage will receive an email as proof of entry.
Only the owner of the account can register. Name and ID are required to be filled up, if the data input do not match, the registration will be rejected. (The participant's ID registered will be published if the participant is qualified to the finals)
The judges reserved the rights to disqualify all entries that are incomplete, and/or illegible. The decision of the judges is final and no correspondence will be entertained.
6. Prizes
Participants are eligible to win only 1 (one) prize in 1 tournament and eligible to represent Malaysia in Global Battle Royale 2007 in Bangkok, Thailand. Prizes are not exchangeable for cash and non-transferable. Gonzo Rosso (M) Sdn. Bhd. reserved the rights to change the prizes without notice as long as the value is equivalent or greater. The prizes are subjected to the current terms and conditions as may be imposed by Gonzo Rosso (M) Sdn. Bhd. from time to time.
7. Finalist Notification
Winners and Finalists for Global Battle Royale 2007 will be notified on the event day itself. An alternate winner will be selected if the initial person selected as winner/ finalist is unable to represent Malaysia to participant the Global Battle Royale 2007 in Bangkok, Thailand for any reason. Winners and finalists will be announced on myRosso RAN Online Official website (http://ran.myrosso.com) and "RAN Battle Royale Malaysia 2007” (http://ran.myrosso.com/br/index.asp).
8. Finalists Responsibilities
Each State's 3 winners(Total 6 finalists) are eligible to represent Malaysia in Global Battle Royale Tournament that would be held in Bangkok, Thailand on 7th October 2007.
Gonzo Rosso (M) Sdn Bhd is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the winners.
By accepting the prizes, the winners agreed to the use of his/her visuals, name, voice, and/or likeness for the purpose of advertising, trade, or promotion without further compensation. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, prizes may be forfeited.
Winners will have to show their Original Identification Card in order to redeem their prizes.
9. Disclaimer
9.1
Gonzo Rosso (M) Sdn Bhd makes no warranty of any kind, expressed or implied, including, but not limited to, warranties of accuracy and expressly disclaims all implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.
9.2
Gonzo Rosso (M) Sdn Bhd shall not be liable to the Participants for any cost, claim, liability, expense, demand or damage whatsoever (including any loss of profit, lost of saving or incidental or consequential damage), arising out of the Participant's entry for the Tournament.
9.3
While every care is taken by Gonzo Rosso (M) Sdn Bhd in the transmission of the questions and information via the Internet, Gonzo Rosso (M) Sdn Bhd shall not be liable for any loss of information howsoever caused whether as a result of any interruption, suspension, or for the tournaments' accuracy or quality of information available, received or transmitted via the Internet to the Participants.
9.4
The Participants shall be solely responsible, and Gonzo Rosso (M) Sdn Bhd shall not be liable in any manner whatsoever, for ensuring that in using the myRosso service, all applicable law, rules and regulations for the use of any online game system, service or equipment shall be at all times complied with.
10. Indemnity
10.1
The Participant undertakes and agrees to indemnify, save and hold harmless Gonzo Rosso (M) Sdn Bhd at all times against all actions, claims, proceedings, costs, losses and damages whatsoever including but not limited to libel, slander or infringement of copyright or other intellectual property rights, death, bodily injury or property damage howsoever arising which Gonzo Rosso (M) Sdn Bhd may sustain, incur or pay, or as the case may be, which may be brought or established against Gonzo Rosso (M) Sdn Bhd by any person including a company or corporation whomsoever arising out of or in connection with the tournament.
10.2
Gonzo Rosso (M) Sdn Bhd shall not be liable for any loss or any damage sustained by reason of any disclosure, inadvertent or otherwise of any information concerning the Participant's Registration Data. Neither shall Gonzo Rosso (M) Sdn Bhd be liable for error, omission or loss due to the neglect of Gonzo Rosso (M) Sdn Bhd.
11. Variation
Gonzo Rosso (M) Sdn Bhd reserved the rights to amend the terms and conditions contained and/or specific terms at any time and the Participant shall be bound by the amended terms and conditions. Notice of the amendment may be given by Gonzo Rosso (M) Sdn Bhd to the Participant in such manner that Gonzo Rosso (M) Sdn Bhd deems appropriate.
12. Waiver
Any failure, delay or indulgence of Gonzo Rosso (M) Sdn Bhd to enforce any term, condition or provision of this Agreement shall not be construed as a waiver of any of Gonzo Rosso (M) Sdn Bhd's right or as affecting the legality or validity of all or any part of this Agreement or the right of Gonzo Rosso (M) Sdn Bhd to take action later.
13. Assignment
The Participant shall not assign any of his right(s) or obligation(s) under this Agreement to any other person whomsoever except with prior written approval of Gonzo Rosso (M) Sdn Bhd.
14. Recourse
If the Participant is dissatisfied with any part of the tournament, or with any terms, conditions, rules, policies, guidelines or practices of Gonzo Rosso (M) Sdn Bhd in organizing the tournament, the Participant's sole and exclusive remedy is to discontinue participation in the tournament.
15. Participant's Acknowledgement
15.1 The Participant hereby acknowledges that:-
a. Participants must read and fully understood all the terms and conditions contained herein upon registering for the tournament.
b. The Registration Data provided to Gonzo Rosso (M) Sdn Bhd are true, genuine and contain the latest information and allows Gonzo Rosso (M) Sdn Bhd to conduct independent verification on the same with any organization or body.
c. Notwithstanding the above, Gonzo Rosso (M) Sdn Bhd reserves the right to reject entries as Gonzo Rosso (M) Sdn Bhd deems fit and necessary without reserving any reason whatsoever.
15.2 The Participant further acknowledges that:-
a. It is Gonzo Rosso (M) Sdn Bhd's policy to use the Participant's data and personal information acquired through the registration process for its business purposes and the Participant hereby grants Gonzo Rosso (M) Sdn Bhd the right to do so;
b. Gonzo Rosso (M) Sdn Bhd may use the Participant's personal information for the internal purposes of customizing advertisements and content on the myRosso website and Gonzo Rosso (M) Sdn Bhd's Partner's sites, providing information to the Participant of other products and services available from Gonzo Rosso (M) Sdn Bhd and its affiliates;
c. Gonzo Rosso (M) Sdn Bhd will disclose the Participant's personal information if required to do so by law, or in good faith, if such action is necessary to:-
(i) Comply with any law enforcement agency, court orders or legal process; or
(ii) Protect and defend the rights or property of Gonzo Rosso (M) Sdn Bhd and its Customers.
16. Miscellaneous Terms and Conditions
Gonzo Rosso (M) Sdn Bhd is not responsible for entries not received due to lost, failed, delayed or interrupted computer, phone line, hardware or software connections and transmissions, for miscommunication, or for other electronic failures, malfunctions or errors.
